1. Introduction and Parties
These Terms and Conditions ("Terms") govern the relationship between WeServonline (Pty) Ltd,
a company registered in South Africa (Registration Number: 2025/503798/07), with registered
address at Sandton, Gauteng, South Africa ("we", "us", "our", or "the Company"), and you ("User",
"Customer", "you").
By downloading, accessing, or using the [App Name] mobile application ("the App") to book a
mobile car wash or detailing service, you confirm that you have read, understood, and agree to be
bound by these Terms.
2. Important Notice regarding the Consumer Protection Act (CPA)
*In compliance with Section 49 of the Consumer Protection Act 68 of 2008, you are advised to read
the following clauses carefully as they: (i) limit our risk or liability; (ii) impose a risk or liability on you;
or (iii) constitute an acknowledgment of fact by you: Clauses 7 (Liability), 8 (Water Usage & Load-
shedding), and 12 (Suspension).
3. Description of Service
The App provides an online platform to connect Customers with mobile car wash technicians
("Service Providers") who will travel to a specified location to perform vehicle cleaning, valeting, and
detailing services. We act as the intermediary/service provider facilitating the booking.
4. Registration and Account
- To book a service, you must register an account providing accurate, current, and complete
information as required by the Protection of Personal Information Act (POPIA) .
- You are responsible for maintaining the confidentiality of your login credentials. You agree to
notify us immediately of any unauthorized access to your account.
- User Warranty: You warrant that you are the owner of the vehicle or have explicit permission
from the owner to allow us to wash the vehicle. You agree to indemnify us against any claims by
third-party vehicle owners.
5. Booking, Payment, and Fees
- Quotations: All prices displayed in the App are in ZAR (South African Rand) and include VAT unless stated otherwise. Final pricing may vary based on vehicle size, condition, and location. A final quote will be provided before you confirm the booking.
- Payments: Payment is processed securely via the App (e.g., Credit Card, Instant EFT, or Mobile
Wallet). We do not store full card details; we use PCI-DSS compliant third-party processors.
- No Cash Payments: To ensure safety and audit compliance, our technicians do not accept cash
payments. All transactions must be processed through the App.
- Cancellation Fee: You may cancel a booking up to 2 hours before the scheduled arrival time free
of charge. Cancellations made after this window, or failure to be present at the location ("No-show"),
will incur a cancellation fee of 50% of the service fee to cover technician dispatch costs.
6. ECTA Compliance (Electronic Communications and Transactions Act 25 of 2002)
In terms of Chapter 7 of ECTA, the following is disclosed:

7. Limitation of Liability (Section 49 CPA Notice)
We exercise reasonable skill and care in performing the wash. However, pre-existing damage
(e.g., loose trim, cracked lights, faded paint) may become more visible after cleaning.
We are not liable for:
- Water ingress into vehicles with known seal defects (e.g., sunroofs, windscreens).
- Theft of or damage to loose items left in the vehicle. Customers must remove all valuables
prior to the wash.
- Damage caused by after-market accessories not properly installed by the vehicle
manufacturer.
- Loss caused by "Acts of God" (e.g., sudden hail storms while the vehicle is wet/soapy).
- Consequential losses (e.g., loss of earnings if you are late for a meeting because the wash
took longer than estimated).
Force Majeure: We are not liable for delays caused by load-shedding (scheduled power
outages), adverse weather, traffic, or riots, provided we use reasonable efforts to notify you.
8. Customer Obligations and Indemnity
Safe Location: You must ensure the parking area is safe, legal (no parking violations), and
accessible. You indemnify us against any parking fines incurred by our technician while parked at
your instruction.
Water Restrictions: You warrant that water usage at your provided address is legal. If the area is
under drought restrictions or requires a pressure pump, you must inform us before the booking
commences.
Hazardous Conditions: You must secure pets and ensure the technician is not exposed to
dangerous conditions (e.g., aggressive dogs, biohazards).
9. Intellectual Property
All content on the App (logos, text, graphics, source code) is our property or licensed to us. You may
not reverse-engineer, copy, or distribute any part of the App without written consent.
10. Privacy and Data Protection (POPIA)
Your use of the App is subject to our Privacy Policy. We collect location data, vehicle details, and
contact information strictly to fulfill the service. We do not sell your personal data to third parties for
marketing purposes without your consent.
11. Prohibited Conduct
You may not use the App to:
- Harass technicians.
- Book fraudulent washes.
- Upload obscene or defamatory content.
- Interfere with the App's security features.
12. Suspension and Termination
We may suspend or terminate your access immediately if you breach these Terms and fail to
remedy the breach within 5 days of written notice.
We may terminate your account without notice if you engage in illegal activity, fraud, or abuse
of our technicians.
13. Dispute Resolution and Governing Law
- These Terms are governed by the laws of the Republic of South Africa.
- Internal Complaint: Please direct complaints to [support@domain.co.za]. We aim to resolve
disputes within 15 business days.
- Consumer Protections: If a dispute cannot be resolved internally, you may refer the matter to
the National Consumer Commission (NCC), the Motor Industry Ombudsman of South Africa
(MIOSA) , or the applicable small claims court.
14. General Provisions
- Amendments: We may update these Terms by posting the new version in the App. Continued
use constitutes acceptance.
- Severability: If any clause is found to be unenforceable, the remainder of the Terms remain in
effect.
